User Agreement- Terms & Conditions

1.0  Introduction

These Terms of Use (including all related policies, notices, guidelines, and forms available on the Platform or via hyperlink) (“Terms”) govern your use of the mobile application provided by Savor Upp Sdn. Bhd. (hereinafter referred to as “Savor Upp,” “we,” or “us”) (the “Platform”). The services we provide include (a) the Platform and (b) services provided by or through the Platform and/or by Savor Upp. Any new features added to the Services are also subject to these Terms. These Terms constitute a contract between you and Savor Upp (“Agreement”).

Please review these Terms carefully. By accessing and using the Platform, you confirm that you have read, understood and accepted the Terms and you consent to the processing of your personal data in accordance with our Privacy Policy. If you do not agree to these Terms, please discontinue your use of the Platform and Services immediately.

The Platform is accessible by (i) individuals aged 18 and above and (ii) corporate legal entities such as companies.

Users under the age of 18 must obtain consent from a parent or legal guardian, who, by accepting these Terms, agrees to be responsible for the user's actions and any associated charges. Without such consent, use of the Platform is prohibited.

Savor Upp reserves the right to modify these Terms at any time. You are encouraged to review them periodically. Continued use of the Services following any modifications constitutes acceptance of the revised Terms.

1.1 Our Services Through our Platform, Savor Upp connects you to third-party Merchants (“Merchants”) where you can order a variety of goods, including prepared and non-prepared food (“Goods”). When you place an order (“Order”), Savor Upp acts as an intermediary on behalf of the Merchant to facilitate, process, and finalize your Order for collection.

2.0 Platform Use and Account Registration

2.1 Registration To access the Platform, you must register for a Savor Upp account by providing a valid email, mobile number, date of birth, dietary preference and a secure password. An OTP will be sent to the mobile number registered for verification purposes. You may need to provide credit card details depending on your selected payment method. Your password must remain confidential and you are responsible for maintaining its security. You accept responsibility for all Orders placed under your account, except in cases of proven fraud.

2.2 Account Termination To delete your account, please send a request via email. Savor Upp may suspend, restrict or terminate your account if we believe:

·   Someone else is using your account; or

·   You have engaged in activities that violate these Terms or abuse the Platform.

3.0 Prohibited Conduct

The following activities are prohibited on the Platform:

·   Violating local, state or federal laws;

·   Posting content that infringes on intellectual property, privacy or other rights;

·   Uploading unlawful, obscene, defamatory, harassing or hateful content;

·   Posting URLs to external sites, spam or HTML code;

·   Impersonating others or engaging in cyberbullying;

·   Collecting personal information without consent;

·   Encouraging others to engage in prohibited conduct.

Savor Upp reserves the right to investigate and take legal action against violators, including removing content and suspending accounts.

4.0 Intellectual Property All trademarks, logos, images and service marks on the Platform are the intellectual property of Savor Upp or third parties. Unauthorized use, reproduction or modification of these materials is strictly prohibited. Savor Upp will enforce its intellectual property rights to the fullest extent of the law.

5.0 Orders

5.1 Order Confirmation When you place an Order, you can find your Order under “ongoing” or “completed” under order history. Orders may include packaging fees and applicable taxes.

5.2 Allergies Savor Upp does not guarantee allergen-free Goods. If you have allergies, please contact the Merchant before placing an Order. Allergens will be noted under “what’s in the bag” by store and not by ordered bag.

5.4 Additional Merchant Terms Your Order may be subject to additional terms or recommended consumption time frame from the Merchant.

5.5 Order Placement Before placing an Order, you must provide your location to display available Merchants within the radius set. Once a Merchant is selected, you can add Goods to your cart and proceed to checkout.

5.6 Order Cancellation Orders may be cancelled before Merchant acceptance. If the Merchant has accepted the Order, no refunds will be issued.

5.7 Refunds Refunds are issued only for cancelled Orders that have not been accepted by a Merchant. Refunds are processed using the original payment method and may require supporting documents. Refunds are always issued in form of Savor Upp voucher.

Savor Upp reserves the right to cancel Orders or suspend accounts suspected of fraudulent activity.

6.0 Pricing and Payments

6.1 Pricing Prices are displayed in Malaysian Ringgit. Additional charges, such as packaging fees, may apply.

6.2 Payment Methods Available payment methods include:

·   Local Credit/Debit Cards (Visa, Mastercard)

·   E-Wallet (GrabPay, Boost, TnG, ShopeePay, Alipay, WeChatPay)

·   Internet Banking (DuitNow Online Banking)

·   Other payment methods as introduced.

Savor Upp reserves the right to modify payment options at any time. All payments are processed through third-party providers, and Savor Upp does not store payment information.

7.0 Order Pick-Up

7.1 Collection Process Orders must be picked up from the Merchant’s premises at the specified Pickup Time. Merchants will not hold Orders beyond the Collection Time and are not obligated to do so thereafter. Order ID should be generated and shown to merchant prior to collection.

7.2 Delays in Pick-Up Delays attributable to you may result in loss, quality deterioration or unavailability of Goods and no refunds or replacements will be provided.

8.0 Promotions and Vouchers

8.1 Voucher Usage Savor Upp may offer vouchers, discounts and promotions (“Vouchers”). These are subject to validity periods, redemption limits and availability while stocks last.

8.2 Voucher Restrictions Vouchers:

·   May not be valid in conjunction with other promotions;

·   Are subject to additional terms;

·   Can only be used on the Platform;

·   Are non-exchangeable and non-refundable.

Section 9.0 – Safety Guidelines & Consumption Recommendations

 

To ensure food safety and quality, customers must adhere to the following consumption guidelines upon pickup of Surprise Bags from our partnered merchants:

 

9.1  Timely Consumption

Surprise Bags must be consumed within 2 to 3 hours of pickup, on the same day.

Fruit Bags: Generally safe for consumption until the next day, but we recommend consuming them within 24 to 36 hours for optimal freshness.

Bakery, Cafe and Restaurant Surprise Bags should be consumed by the end of the same day to maintain quality and taste.

9.2  No Liability for Food Safety Post-Pickup

The company facilitates the sale of surplus food but does not take responsibility for any food-related concerns after pickup.

Customers are responsible for inspecting and handling food properly upon collection.

9.3  Merchant Accountability & Quality Monitoring

We work closely with our partnered merchants to ensure food meets a certain standard before pickup.

If a customer reports an issue, we will communicate with the merchant and take appropriate action, including monitoring repeated complaints.

9.4  Storage & Handling Responsibility

Customers must store food appropriately based on temperature sensitivity and perishability.

The company does not provide guarantees on storage conditions post-pickup.
